How Soon After An Accident Do I Need To Make A Claim?
If you have been injured in an accident through someone else’s negligence or because something was unsafe, you are likely to be entitled to a compensation payment. At McGee Solicitors, our friendly and approachable solicitors can advise you of how to start a claim and represent you throughout to ensure you achieve the best possible pay-out.
How Soon After An Accident Do I Need To Make A Claim?
Ideally, you should speak to a solicitor as soon after your accident as possible. If you ask us to represent you, we will start work straight away, collecting evidence and contacting the solicitor for the person responsible for your injuries or their insurance company.
However, if you have not started a claim and some time has passed, you should still speak to a solicitor. You can usually bring a claim for up to three years after an accident, sometimes longer.
At McGee Solicitors, we are accident compensation experts and you will find our solicitors to be helpful and understanding. We offer a free initial consultation so that you can find out about the accident compensation claims process and ask us any questions that you may have. For example, you may want to know how long your claim is likely to take or how much compensation you might be entitled to. We can also explain our funding options to you, which include risk-free funding so that you do not face any financial liability, should your claim not be successful.
We can discuss your options with you and let you know what steps you need to take. To speak to one of our expert accident lawyers, ring us on 028 90 394 131 or fill in our no-obligation Free Enquiry Form.
“Used McGee Solicitors recently and I would highly recommend them for their service. They were friendly, approachable and very professional. They put me at ease from the start and made everything straight forward. They were always available when I needed their advice throughout. Thank you for all your help.”
Making A Compensation Claim After An Accident
Speaking to a solicitor as soon after an accident as you can will help ensure that no evidence is lost and that witness statements can be gathered while the incident is still fresh in everyone’s memories. If you speak to us and we represent you, we will start work at once, building a strong case on your behalf.
We will obtain information from those involved, such as accident investigators, the police, medical professionals, your employer or those in charge of the place where the incident occurred, such as your workplace or a supermarket. We will also write to the other side and notify them of your claim for accident compensation.
You should seek medical help straightaway so that you have the treatment you need and so that there is a record of your injuries while they are at their most severe. You should also make sure that you attend follow up appointments and any other treatments or physiotherapy that are recommended.
If the other side admits liability, we can arrange for medical reports to be prepared so that we can negotiate the amount of your compensation based on the opinions of medical experts. You may be advised to wait for a while before settling your claim to see how your injuries heal and whether you will be left with any long-term difficulties that you should be compensated for.
Where the other side does not admit liability or they do not offer enough money by way of compensation, your case will go to court. We know that this may seem daunting and we will ensure that you have the support and representation that you need throughout.
How Long Do You Have To Make An Accident Compensation Claim?
You will usually have three years from the date of your accident in which to issue court proceedings in respect of a compensation claim. If the claim is in respect of a child, the three-year period starts from the date of their 18th birthday.
If you were not aware of the injury at the time, for example, if you were exposed to something at work that gave you an industrial disease, then the three years starts from the time that you became aware of your condition, usually when you receive a medical diagnosis.
In the case of medical negligence, the three years starts from when this is confirmed as having caused your injury or illness, which could be some time after the actual incident.
Because your claim needs to be filed with the court within the three-year period, your solicitor will need to start work several months in advance of this, to ensure that a robust case can be put together. This means that it is important to speak to us as soon as possible if you would like to request compensation, so that we can get to work straightaway.

“Having very little insight into the process of claims for road traffic accidents I didn’t know how I could or even would claim. Unfortunately I sustained injuries as a result of the trauma from the accident and was encouraged by my nephew to let McGee Solicitors undertake my claim. I was guided by the firm to the process and was updated on a regular basis regarding status of claim and always given clarification and information. I would encourage anyone who like me was ‘green’ to the process of claiming let McGee Solicitors represent them. I can only thank them right now for their help and the positive outcome of my claim.”
