How Long After A Crash Can You Claim Whiplash?

You will usually have three years from the date of your accident in which to issue court proceedings in respect of a compensation claim. If the claim is in respect of a child, the three-year period starts from the date of their 18th birthday.

If you were not aware of the injury at the time, for example, if you were exposed to something at work that gave you an industrial disease, then the three years starts from the time that you became aware of your condition, usually when you receive a medical diagnosis.

In the case of medical negligence, the three years starts from when this is confirmed as having caused your injury or illness, which could be some time after the actual incident.

Because your claim needs to be filed with the court within the three-year period, your solicitor will need to start work several months in advance of this, to ensure that a robust case can be put together.
