How Long After A Crash Can You Claim Whiplash?
If you have been injured in a car crash and you have suffered whiplash, you may be wondering how long after a crash can you claim whiplash? The extent of whiplash injuries may not be immediately apparent or you might not have considered bringing a claim straightaway.
While you are always recommended to seek legal advice as soon as possible after an accident, it does not matter if some considerable time has passed as you can generally bring a claim for at least three years after the date of the accident or after the date on which you realised that you had been injured.
At McGee Solicitors, we have in-depth experience in bringing successful whiplash claims, to include claims that are not brought straight away after the accident. Our solicitors are friendly and helpful and we will be happy to speak to you about your accident and answer your questions.
We offer a free initial consultation, which will give you the opportunity to talk to us about what has happened and ask us about issues such as how much compensation you might be awarded and how to fund your case without risk to yourself.
We guarantee that you will keep 100% of your compensation.
“Very helpful and more importantly knowledgeable about the issues I was concerned about. Put at ease right away by Michael and I am more than happy with the outcomes and would really recommend McGee Solicitors for all your legal requirements. Take advantage of the free initial consultation, you won’t look back.”
Whiplash Injuries And Claiming Compensation For Whiplash
Whiplash is caused by the sudden jolting of the body so that your head is jarred backwards and then thrown forward. It is often caused by a car accident, in particular being hit from behind by another car while you are stationary. It can also be as a result of a fall or slipping and hitting the ground hard.
If the accident was not your fault, you are likely to be entitled to claim compensation from the insurer of the person at fault, such as the driver or the supermarket, if you slipped on a wet floor.
You should make sure that you keep records of what happened and that you go to a hospital for treatment. As well as ensuring that you have property medical attention, this will also mean that you have medical records available to support your claim.
Even if it has been some time since your accident, if you are experiencing pain then you should seek medical advice and support. You should also make sure that you go to all of the appointments that are recommended.
If you ask us to represent you, we will obtain your medical records and contact the other party’s insurer to advise them that we are bringing a claim on your behalf. We will also ask medical experts that we work with in respect of whiplash claims to prepare a medical report on your injuries.
If the other side admits liability, we will negotiate with them to obtain a compensation payment on your behalf. It is usually possible to reach agreement without the need for a court hearing.
If liability is not admitted or we do not believe that they have offered sufficient compensation, we will prepare a strong case for court and instruct an expert in whiplash injuries to represent you.
How Long Do I Have To Make A Whiplash Claim After An Accident?
Whilst it is always recommended that you speak to a solicitor as soon after an accident as possible, it might be the case that some time has passed since you were injured. You are still advised to speak to a solicitor as you will usually have up to three years to start the claim and sometimes longer.
If you were not initially aware that you were injured, then the three year period will run from the date on which you did know that you were injured.
If the person who was injured was a child, then they have a period of three years from the date of their 18th birthday to make a claim.
By making a claim as soon as you can, the accident will be fresher in your memory and you will be able to better describe what happened. However, if the accident was some time ago, you are still entitled to be compensated if you suffered whiplash injuries that were not your fault.
How Soon Will My Whiplash Claim Be Settled?
While some claims are relatively minor and can be settled within six months or so, whiplash injuries can be more severe in some cases and you may be advised to wait to see how well you recover before agreeing on a sum in compensation.
You could find it difficult to move your head, have bad neck pains and/or shoulder pains or have pain that has spread elsewhere, such as into your arms. If you have other injuries as well as whiplash, we will ensure that these are included in your claim.
Our medical experts will prepare a report on your injuries and we can discuss the best course of action with you. Throughout your claim, we will always make sure that we are available to speak to you to talk through the progress of your case and answer all of your questions.
