Accident Book At Work BelfastWork accident book rules state that your employer must maintain a work accident book if they have more than ten employees and that injuries and incidents need to be properly recorded in it. The book can be online or a physical book.

If you are injured at work, a written record should be made of what has happened. This needs to include the following details:

  • The time and date of the accident
  • Where the accident happened
  • Details of what happened, including events leading up to the incident and anyone else who was involved
  • A list of the treatment given to you and any information you were provided with

The report should be made as soon as possible after the accident while the information is still fresh in your memory. You should be allowed to read through the report to check that it accurately reflects what happened.

Serious incidents such as fractures, burns and head injuries that cause any loss of consciousness should also be reported to the Health & Safety Executive Northern Ireland under the Reporting of Injuries, Diseases and Dangerous Occurrences Regulations (Northern Ireland) 1997, also referred to as RIDDOR. This also applies to accidents that require you to have more than seven consecutive days off of work.

What Happens If My Employer Does Not Record My Accident?

If your accident was not recorded, you are strongly advised to contact a solicitor as soon as possible. You can ask your employer to put the accident into the book but if they do not, you should make your own written record of what happened, to include who else was involved or witnessed the incident.

Where possible, you should also take photographs of the area and any hazard or equipment that was involved in your accident. You can also ask witnesses for their contact details so that they can be approached to provide a statement if necessary.

While the formal report from your employer’s accident book would normally form part of a legal claim, you will usually still be able to claim even if your employer failed to make any notes about the incident.
