Dealing With Accident Forms At Work

Accident At Work Forms BelfastYour employer is required by law to keep a record of any accidents that happen while you are working for them.

The accident report should go on a form that includes:

  • The date of the accident and what time it occurred
  • Details of what happened, including events leading up to it
  • Information about your injuries
  • What treatment you were offered and received
  • What information you were given about the steps you could take next

You are advised to make your own notes about what happened. If possible, you can also take photos in support of your case showing the area where the incident occurred and any equipment or hazards that were involved.

If there were witnesses, ask them for their contact details so that they can be approached at a later date to give a statement if necessary.

Once your employer has written up the incident report on a work accident form or in the work accident book you are entitled to see it, although not to have a copy. You should read it through to check that everything is correct.

If your employer does not make a report of the accident even if you ask them to, you can still make a claim. It is important to record the incident yourself as soon as possible after it happens so that the details are still fresh in your memory.

You are also strongly advised to speak to an expert work accident solicitor without delay. If you ask us to represent you, we can request a copy of the accident report as we start your case.

“Cannot recommend McGee Solicitors highly enough, did a great job for me in helping with an accident claim, I was thrilled with the settlement they achieved for me, Thanks guys.”

Bringing A Work Accident Compensation Case

Accident At Work Forms BelfastWe will also advise your employer that you intend making a claim for compensation for what has happened. They are required to have insurance in place to cover work accident claims and we will contact their insurer to ask whether they will admit liability.

We will put together details of what happened and ask a medical expert to examine you and prepare a report on your injuries. If the other side agrees that the accident was your employer’s fault, then we can start negotiations to try and agree on a sum in compensation.

Your employer has a duty of care towards you and where they have breached this, they will be liable. A failure in their duty of care could be because:

  • They have not provided adequate safety equipment
  • They have not provided proper training to you or to a colleague
  • Thy have not provided a safe and hazard-free working environment
  • They have failed to carry out risk assessments
  • They have not complied with health and safety legislation

What Compensation Will I Receive For A Work Accident?

If your employer admits liability for your injuries or a court finds that they were liable, then you can expect to receive two types of damages payment:

  • General damages; and
  • Special damages

A general damages payment is compensation for pain and suffering and loss of ability to do things.

A special damages payment is compensation for the financial losses you have sustained as a result of the accident, such as loss of earnings if you have had to miss work, prescription costs, medical care not covered by the NHS, prescription charges and special equipment.

If you ring to speak to us, we can give you an idea of how much compensation you might expect to receive. We have very wide experience of all types of personal injury and consequently a good understanding of the range of compensation paid.
