Bus Accident Settles for £9,000- Case Study
Our client was a passenger on a bus where a car collided with the side of the bus.
Our client did not claim immediately and in fact he waited until nearly 2 ½ years after the accident before contacting ourselves about a compensation claim. Because his claim was within the 3 year time limit of an accident he was still able to make a claim. We quickly wrote to the insurance company for the car and asked them to accept liability immediately.
We also obtained an orthopaedic report for our client’s injuries as quickly as possible as we were aware that the 3 year limit was quickly approaching.
We obtained an initial orthopaedic report regarding our client’s injuries in which he had suffered soft tissues injuries to his neck, shoulders, back and also his chest. The orthopaedic surgeon advised that he needed an MRI scan to make sure that there was nothing underlying or sinister about his symptoms. We arranged for our client to have an MRI scan and a follow up report from the orthopaedic surgeon was obtained.
At this point we were weeks away from the 3 year limitation period to be able to make a personal injury claim. We issued Court proceedings to ensure that the time limit was not missed. That meant that we were able to obtain the MRI scan and a further medical report for our client without worrying that we were going to miss the time limit.
Compensation of £9,000
Once we had completed our client’s medical evidence and received his further report from the orthopaedic surgeon we sent this to the insurance company. We were able to negotiate a settlement of £9,000 for our client’s claim. All legal costs and outlays including the orthopaedic reports and MRI scans were paid for by the insurance company for the other vehicle.
This meant that making a claim for compensation did not cost our client anything and the entire service was free of charge.
