Whiplash Claims From Rear Impacts
When a vehicle is hit from behind, those travelling in the vehicle are at risk of sustaining a whiplash injury. This is because the force of the impact throws their head backward, forward and then backward again, making a very sudden ‘whipping’ motion.
When this happens, the muscles and soft tissues hyper – extend beyond their normal range of movement. The tissue tears, resulting in swelling and associated symptoms, such as pain and reduced mobility.
When these symptoms arise following a rear end shunt, those affected will almost certainly be diagnosed with whiplash. Whiplash cannot be detected with imaging tools such as x-rays, so a diagnosis is made based on the symptoms alone.
It can take weeks or months for whiplash to resolve. In chronic cases, a whiplash injury can continue for years. Even if someone does become pain-free, it is likely that there will always be an underlying weakness. This can create problems in the future.
Whiplash claims often arise as a result of a rear impact. If you have developed whiplash following a rear impact and you were not at fault for the accident, you could be entitled to compensation.

What is a Rear Impact?
A rear impact is when the front of a vehicle drives into the back of another vehicle. Hence the name, a ‘rear impact’.
The driver of the second vehicle is almost always responsible for a rear impact. Often this is because he/she is not concentrating, and so does not react quickly enough when the vehicle ahead slows down.
It might also happen because the driver is tailgating, or is driving at excessive speed, and so collides into the back of the vehicle in front when it brakes. This is particularly common at a junction, a traffic light or when the vehicle in front has to react to something unexpected, like a pedestrian stepping out into the road.
Whiplash Compensation
If you have suffered whiplash due to a rear end shunt, you should speak to a personal injury solicitor about your options. If the accident was not your fault, you could be entitled to compensation. This applies regardless of whether you were the driver or a passenger.
If you were travelling as a passenger in the vehicle which caused the accident, then you are also entitled to claim compensation for whiplash. Even if you know the driver at fault.
As with all personal injury claims, the compensation you are awarded is intended as redress for your pain and suffering. It is also intended to recover any money you have lost because of the accident.
