Can I Claim Compensation For Medical Negligence?
Healthcare professionals have a duty to provide treatment of a reasonable standard in light of the expected level of expertise of their profession. If the care and treatment you receive falls below this reasonable standard and you are harmed as a result, you may be able to claim compensation.
This could be treatment from a range of professionals, including doctors, surgeons, nursing staff, dentists and mental health practitioners.
If you ask us to represent you, we will establish the criteria for your claim:
- You were owed a duty of care;
- That this duty of care was breached; and
- You suffered harm as a result

How Do I Claim Compensation For Medical Negligence?
If you contact us, we can discuss with you what has happened and contact your healthcare provider and their insurer to let them know that you will be claiming medical negligence compensation.
The early stages of a medical negligence case involve collating evidence, including medical records. We will also ask our medical experts to examine you and put together reports outlining your injuries and assessing how these are likely to affect you on an ongoing basis.
We will ask the insurer whether they are able to admit liability. If they do, we can negotiate the size of your compensation payment with them.
If they do not admit liability or if the amount offered is not enough to fully compensate you, we can take your claim to court and ask a judge to decide the case.
How Much Is Compensation For Medical Negligence?
If medical negligence is admitted or the court agrees that you have been the victim of medical negligence, you will be entitled to receive two types of damages, namely general damages and special damages.
General damages are intended to compensate you for the pain and suffering involved in your injuries as well as any loss of amenity. This is where you may be unable to do things that you used to do, such as sports or walking comfortably or housework.
Special damages is compensation for financial losses that you may have suffered because of the negligence. Examples of items that can be claimed under special damages include prescription charges, the cost of travel to medical appointments, treatment that you need that is not provided by the NHS and the cost of buying special equipment needed because of your injuries.
The total amount you will be paid will depend on how severe your symptoms are and how long they are likely to last. Our solicitors have extensive experience in valuing medical negligence compensation claims and will be happy to discuss your case with you and give you their opinion.
You can also use our compensation calculator.
Is There A Time Limit For Medical Negligence Compensation?
The usual time limit in which a medical negligence compensation claim should be started is within three years of when the incident occurred. An exception exists if you did not know at the time that you had been harmed. In that case, the three year period will run from the date on which you should reasonably have realised.
In the case of children and young people, the three year time limit does not start until their 18th birthday. There is no time limit in the case of individuals who lack the mental capacity to manage their own affairs.
How Can I Fund A Medical Negligence Claim?
While no win no fee medical negligence funding is not available in Northern Ireland, we are able to offer a range of other options, including legal expenses insurance. This will enable you to bring a medical negligence claim at no risk to yourself.
If your claim is not successful, the insurance policy would cover your legal fees. If your claim is successful, a modest insurance premium would be payable from your compensation.
In some circumstances, Legal Aid is available for medical negligence claims. We can advise you whether it will be an option in your case.
If you win your case or it is settled by way of an out of court agreement, you can expect the other side to pay your reasonable expenses.
We offer a free initial consultation so that you can ask us any questions you may have about paying for your case and how much compensation you might receive.
How Long Does A Medical Negligence Claim Take?
The length of time taken to finalise a medical negligence claim will depend largely on how severe your injuries are and your prognosis. If you have been badly affected by medical negligence, you are likely to be advised to wait and not settle too quickly. This will ensure that you can be properly compensated for all future issues you may have.
In this event, we can ask the insurance company to make interim payments to you, if necessary, to ensure that you have financial support during the time it takes to deal with your claim.
“Michael was absolutely amazing through my time with him, constantly checking on my mental and physical state as well as keeping me updated regularly. I couldn’t recommend a better team to work with in any legal situation.”
