Driving “Over the Limit”

Drink Driving SolicitorsThere are a number of different offences related to drink driving. The most common is driving while over the prescribed limit. In Northern Ireland, the legal limits for drink driving are currently:-

  • 35 microgrammes of alcohol per 100 millilitres of breath
  • 80 milligrammes of alcohol per 100 millilitres of blood
  • 107 milligrammes of alcohol per 100 millilitres of urine

The penalties for drink driving vary depending on whether or not it is your first offence, and whether or not you caused death or grievous bodily injury. For driving over the prescribed limit you could receive:-

  • Six months’ imprisonment
  • A fine of up to £5,000
  • A driving disqualification for at least 12 months
  • A driving test before your licence is restored

Sometimes drivers are stopped and breathalysed in the morning, having drunk the night before. In such situations the law (and the penalties) are exactly the same.

If you have been arrested for driving over the prescribed limit, contact our drink driving solicitors without delay.

We can use our expertise to your advantage, limiting the potentially devastating consequences of a drink drive conviction.

Drunk in Charge of a Vehicle

In Northern Ireland, you are not allowed to be drunk in charge of a vehicle. This means that even though you were not driving at the time of your arrest, the police believe that you were “in charge” of the vehicle while you were over the legal limit.

The penalties for being drunk in charge of a vehicle include –
Drink Driving Solicitors

  • Three months’ imprisonment
  • A fine of up to £2,500
  • A driving disqualification
  • Penalty Points

Being drunk in charge of a vehicle is a technical area of the law and as specialist drink driving solicitors we know how to argue this defence and we can represent you in court.

Refusing or Failing to Provide a Specimen

If the police request that you provide a specimen of breath, blood or urine, you are not allowed to refuse without good reason. Otherwise you could face –

  • Six months’ imprisonment
  • A fine of up to £5,000
  • A driving disqualification for at least 12 months
  • A driving test before your licence is restored

If you are to avoid such penalties, it is necessary to show the court that you did have a reasonable excuse for refusing a test (such as a medical condition), or that there were mitigating circumstances. Call us today to discuss this further.

They take care of everything hassle free very friendly and super helpful with any question you may have, and away keep you updated on what’s happening.
