Many people who are facing driving offence charges have never been before the Courts before and the whole experience can be very distressing and worrying. Losing your driving licence and not being able to drive would be catastrophic for most people. You may lose your job or no longer be able to help family members who rely on you.
It is important to have an experienced criminal or driving offence solicitor with you at Court or the Police Station as the outcome can be very different if you try to do it yourself, or use a solicitor who does not really deal with driving offences. The outcome could be a longer driving ban, or a conviction for a driving offence which may have been able to be avoided if you had used an experienced solicitor.
It is important to consider how much that will actually cost you in terms of whether you lose your livelihood because of the driving ban, which could have been avoided, or the effect on your family life and the ability to help your children or family members and the impact that has on your day to day life.
When considering whether to use a solicitor for your driving offence it is important to take this into consideration as we find that using our services gives our clients huge peace of mind and a better control of what the outcome could be when it goes to court and the best chance of getting the best result possible for your case.

Being taken to Court or stopped by the Police for a driving offence is now very common. The police now use various forms of technology to investigate and charge people with driving offences. This can include speed cameras and also number plate recognition technology which they use frequently to check whether vehicles are insured or not.
This means that being accused of a driving offence now happens very frequently. It can often begin with a letter from the Fixed Penalty Office asking whether you were the driver of the vehicle and asking you to confirm who the driver was. This is usually the case with offences such as speeding or breaching a red light.
For more serious criminal charges the police will arrest you and interview you as to your involvement with the offence. This is more common for charges such as dangerous driving or careless driving.
If you have received a letter from the Fixed Penalty Office and you are not sure about it or the Police have been in contact with you looking to question you, call us now and we can give you expert advice and guidance so that you are prepared for the interview and you are fully aware of the allegations made against you.
If your case can be resolved through the Fixed Penalty Office and you accept the fixed penalty, then that should be the end of the matter with the penalty points being endorsed on your licence. However, if you do not want to accept the Fixed Penalty Notice or you did not accept it in time and you are being brought to Court then call us now on 028 71 229 343 for advice.
If the charges are more serious and cannot be dealt with by way of a fixed penalty then you will be interviewed by the Police and the case will be passed to the Public Prosecution Service who will review the evidence and then decide whether or not you are to be taken to Court. It can take months for a case to proceed to Court and this waiting period can be very stressful as you often do not know whether or not you are going to end up in Court or not.
Are You Facing Driving Offence Charges?
We are experienced in dealing with all types of driving offence cases and we will be able to give you expert advice and representation both in the police station and at Court. We will be able to assess the evidence against you and give you advice on whether you are in a position to fight the charges or whether the evidence against you is overwhelming .
We are able to robustly fight driving charges if that is required and do everything in our power to get the best possible result for you in the circumstances.
If it is the case that the evidence against you is overwhelming and a guilty plea is appropriate then we will do everything to ensure that the sentence you receive is as low as possible in the circumstances and that all points of mitigation are put forward to the Court.
We can instruct expert motoring offence barristers and also experts who can provide a report to Court detailing the circumstances of an accident for example to argue who was at fault for a collision and who can come to Court to give evidence in support of your case.
We are experts in defending driving offence charges and offer a free consultation with an expert solicitor. Call us now on 028 71 229 343 to discuss your case.
If the police have already questioned you and you have received the Summons to Court or they have charged you to Court then call us today.
“Very professional in their approach, very supportive and adaptable to my needs. I could not recommend McGee Solicitors enough. I will definitely be using them again.”
Will I Lose My Driving Licence?
Whether or not you will lose your driving licence after a conviction for a driving offence depends entirely on the offence you are charged with, but also the seriousness of the offence. If it is a very serious offence then a driving disqualification is usually mandatory for example dangerous driving carries a one year mandatory driving ban. However, whether you will lose your driving licence or not also depends on whether you have penalty points on your licence and what your driving record is like. This will be taken into account by the Judge in sentencing.
Whether or not you have points on your licence can affect whether you “top up your penalty points to 12 points”. If you reach 12 penalty points then you could be facing a 6 month driving disqualification.
If you are concerned or worried that you might lose your driving licence or you are not sure what penalty points you have and whether they apply at the time of the offence, then give us a call now and we will be happy to talk to you and discuss your case and give you free advice and hopefully some peace of mind.
Will I Be Disqualified From Driving?
Again, this depends on the driving offence you have been charged with, but also how serious the circumstances of the case against you is.
Your driving record will also be considered by the Judge. Some charges carry a mandatory disqualification which means that it is not possible to avoid a driving disqualification. This is the case with dangerous driving which carries a one year driving ban and also drink driving which also carries a minimum one year driving ban. With a drink driving disqualification it may be possible to reduce your disqualification if the Judge certifies you for the drink driving course which could reduce your disqualification by 25% which is a significant reduction if you successfully complete the course.
How Much Will It Cost?
We provide a free consultation with an expert solicitor who can assess the evidence against you and give you clear straightforward advice and hopefully give you some peace of mind as to what the outcome of your case may be.
We can also apply for Legal Aid for you. If you are required to attend a police station we can attend with you and provide representation and advice for you at no cost. This will be covered under Legal Aid and having a solicitor attend a police station with you will cost you nothing.
If your case goes to Court then we can apply for Legal Aid for you. There are a lot of driving offence charges which will qualify for Legal Aid, and are dependent upon your financial circumstances, such as dangerous driving. We will be able to assess whether you qualify for Legal Aid during the free consultation.
Some driving offences do not qualify for Legal Aid, such as speeding or failing to produce your licence or insurance details to the police. These charges are not seen to be serious enough to qualify for Legal Aid. If you have any concerns about how much it will cost to instruct us, then call us now on 028 71 229 343 and we will be happy to talk to you about this. If you are not entitled to Legal Aid then we will be able to give you advice on the cost of legal representation from the outset. We will ensure that there are no hidden costs going forward.
